Eligible salons:

Entry is open to all salons within Australia that sell Redken products and have been invited to enter this Promotion by their Redken sales representative/Business Consultant.  

How to enter:

To enter, an Eligible salon must:

(a)     spend at least $2,000 (excl. GST) on Redken products between 1 January 2016 and 31 December 2016 (purchase must be from the Promoter directly via a Redken sales representative or through Client Services) (“Eligible Spend”);

(b)     purchase and stock Redken Haircare, Styling, Cerafill, Redken For Men between 1 January 2016 and 31 December 2016 (purchase must be from the Promoter directly via a Redken sales representative or through Client Services);

(c)     purchase all Redken Launches and Promotions from 1 January 2016 to 31 December 2016; and

(d)     reach their 2016 Redken Sales Target by 31 December 2016. Each Eligible salon will be notified of their 2016 Redken Sales Target by their Redken Business Consultant. The sales target indicates the amount of Redken products they must purchase from the Promoter between 1 January 2016 and 31 December 2016.

 

The Promoter will determine whether an Eligible salon has met the above requirements by referring to their own internal invoicing records. In the event as to a disagreement regarding invoicing records for the purpose of determining winners and meeting the entry requirements above, the Promoter’s decision will be final.

 

Eligible salons will be divided into two (2) tiers based on their Eligible Spend amount, as indicated below:

Not transferable, substitutable or exchangeable nor redeemable for cash (including any unused portion).

 

The Promoter will be organising and implementing the design and build for the Redken renovation in consultation with each winning salon, taking into account the prize budget allowance. Each company from which the Promoter places an order for the purposes of organising the prize cannot be less than $1,000 excl GST (e.g. a winner cannot select one or more items from one company, where the total spend from that company for the prize is less than $1,000 excl GST). In the event of a dispute between an owner, manager or employee of a winning store and the Promoter so to any details regarding the renovation (including design and build), the Promoter’s decision will be final. The Promoter does not warrant that any items or design selections by the winning salon will be implemented, and the Promoter will have final determination as to the design and any items to be installed in the winning salon.

Notification of prize winners:

The Promoter will notify the winning salons via phone, email and/or in person.

Unclaimed prizes:

In the event of a prize which is unclaimed, the Promoter may at its discretion assign the prize to the entry who would have been the winner had the original winning Eligible salon not participated in the Promotion. The Promoter is under no obligation to award any unclaimed prizes.



Terms and Conditions

  1. The entrant agrees and acknowledges that they have read these Conditions of Entry (and Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.
  2. The Promotion commences on the Start Date and ends on the End Date ("Promotional Period").
  3. Winning Determination:
    1. The Promoter will review its records of the total Redken product purchases made by Eligible salons from the Promoter via a Redken sales representative/business consultant (i.e., customer invoice price excluding GST minus any deductions for returns, discounts, rebates, specials etc) between 1 January 2016 and 31 December 2016 (“2016 Sales Period”) and compare this to their 2016 Redken Sales Target (as provided by their Redken Business Consultant) to determine the winners for this Promotion. The Promoter will determine their percentage growth over target (“Percentage Growth Over Target”) for each Eligible salon by comparing the total value of purchases of Redken products from the Promoter during the 2016 Sales Period with their 2016 Redken Sales Target.
    2. The Eligible salon in each of the five (5) State/Territory Groups (i.e. in each of – (1) VIC/TAS; (2) WA/NT; (3) NSW/ACT; (4) QLD; (5) SA)) with the highest Percentage Growth Over Target for their Tier group will each win the prize indicated in the Schedule table above.
    3. Any returned or cancelled Redken product purchases will not be considered in determining the Percentage Growth Over Target.
    4. In the event of a tie for a prize based on Percentage Growth Over Target, the Promoter will break the tie by referring to the total value of purchases of Redken products by each respective tied Eligible salon during the 2016 Sales Period (with the tied Eligible salon with a higher total value of purchases of Redken products during the Promotional Period being the winner). If a tie still exists after the above tie-break mechanic is implemented, then the Promoter will send an authorised representative of each respective tied Eligible salon a promotional question to answer in 25 words or less. The answer must be provided back to the Promoter within the time-frame specified by the Promoter, otherwise they may at the Promoter’s discretion be invalidated and ineligible for a prize. The respective tied eligible Salons will be re-ordered based on their answer provided, with the best eligible Salon that provides the best answer based on creative merit and originality, as judged by the Promoter (or a representative of the Promoter), determined the winner. For the sake of clarity, there will be a maximum of ten (10) prizes awarded in total (one (1) prize for each of the two Tiers per State/Territory Group).
    5. Chance plays no part in determining the winners. The Promoter’s decision is final and binding and no correspondence will be entered into.

  1. All reasonable attempts will be made to contact each winner.

  2. If any winner chooses not to take their prize (or is unable to), or does not claim or take a prize by the time stipulated by the Promoter, they forfeit the prize and the Promoter is not obliged to substitute the prize.

  3. If any prize is unavailable, the Promoter reserves the right to substitute that prize with another prize of equal or greater value and/or specification.

  4. No entry fee is charged by the Promoter to enter the Promotion.

  5. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.

  6. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may collect entrants’ personal information (including through its contractors or agents) or disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with, or developing its relationship with, entrants including to overseas locations such as New Zealand, the USA, Canada, Singapore and other countries in Asia and the EU. By entering this competition, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future competition and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter. The Promoter is bound by the Privacy Principles in the Privacy Act 1988.  Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address stated in the Promoter section of these conditions. The Promoter’s Privacy Policy, located at www.loreal.com.au/_en/_au/tools/privacy/privacy_1.aspx, contains information about:

    (a) how entrants can seek access to the personal information the Promoter holds about them and seek the correction of such information; and

    (b) how entrants can complain about a privacy breach and how the Promoter will deal with such a complaint.

  7. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

  8. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries.

  9. The Promoter reserves the right, at any time, to validate and check the authenticity of the data/purchase records (used to determine the winning salons) and salons’ and their employees’, managers’ and owners’ details. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible purchases, as applicable, will at the Promoter’s discretion be deemed invalid and not eligible to be considered in determining a winning salon.

  10. The Promoter reserves the right to disqualify salons and purchases used to determine winning salons in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.

  11. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or willful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

  12. The employees, manager/s and owner/s of any winning Eligible salon (as a condition of accepting a prize) will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) them and their salon being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.

  13. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.

  14. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
